O2 Best Trade-In Price Promotion

Terms and Conditions

1. Introduction

1.1 These terms and conditions (the “Terms”) govern the O2 Best Trade-In Price Promotion (the “Offer”). By participating in the Offer, you agree to be bound by these Terms.

1.2 The Offer is provided by Telefonica UK Limited, 500 Brook Drive, Reading, Berkshire, RG2 6UU, United Kingdom (“O2”).

1.3 These Terms contain the full terms that apply to the Offer. If there is any conflict or inconsistency between these Terms and any advertising or promotional materials, these Terms will take precedence.

2. The Offer

2.1 Eligible Customers who make a Qualifying Purchase with a Qualifying Recycle during the Offer Period will receive an O2 Recycle trade-in value which is £1 higher than the highest Standard Competitor Trade-In Value identified by O2 for the same eligible device, subject to these Terms (the “Promotional Trade-In Value”).

2.2 For the purposes of these Terms:

a. “Eligible Customer” means a new or existing O2 consumer customer who meets the requirements in clause 3;

b. “Networks” means any mobile network provider that offer and operate their own device trade-in scheme, being EE, Vodafone, Three, Sky Mobile, ID Mobile and giffgaff. This excludes third-party trade-in services to which a network may refer or signpost customers;

c. “Standard Competitor Trade-In Value” means the standard publicly available trade-in value offered directly by a Network for the same model and storage capacity of device and based on materially equivalent device-condition assumptions. This excludes any promotional or enhanced trade-in offers;

d. “Qualifying Purchase” has the meaning given in clause 4;

e. “Qualifying Recycle” has the meaning given in clause 5; and

f. “Offer Period” has the meaning given in clause 6.

2.3 The Offer compares O2 Recycle trade-in values against the Standard Competitor Trade-In Values offered by the Networks only.

2.4 The comparison does not include:

a. temporary, enhanced or promotional trade-in values;

b. additional trade-in bonuses or promotional uplifts;

c. cashback, vouchers, gift cards, gifts or other incentives;

d. values available only through discount codes, membership schemes or personalised offers;

e. offers available only to particular groups of customers or through employee, business or affinity schemes; or

f. any other benefit which does not form part of the Network’s standard trade-in value for the relevant device.

2.5 The Promotional Trade-In Value is not transferable, exchangeable or redeemable for cash except where a cash payment method is expressly available under the O2 Recycle terms. No other alternative is available.

2.6 The Offer cannot be used with O2 Switch Up. If you use O2 Switch Up to swap your device, you will not be eligible for this or any other O2 Recycle offer promoted in connection with the purchase of your new device.

3. Eligibility and Participation

3.1 The Offer is open to UK residents aged 18 or over who:

a. make a Qualifying Purchase directly from O2 during the Offer Period;

b. register an eligible device for a Qualifying Recycle as part of that Qualifying Purchase;

c. complete the Qualifying Recycle in accordance with these Terms and the O2 Recycle terms and conditions; and

d. meet any applicable credit, availability and eligibility requirements for the relevant O2 Refresh contract.

3.2 The Offer is available to new and existing O2 customers.

3.3 The Offer is not available to:

a. O2 Pay As You Go customers;

b. O2 Business customers;

c. customers purchasing through a third-party retailer or indirect sales channel;

d. customers using O2 Switch Up to obtain their new device; or

e. any person who does not complete both the Qualifying Purchase and Qualifying Recycle in accordance with these Terms.

3.4 One Offer may be claimed per Qualifying Purchase and per Eligible Customer.

3.5 The Offer is for personal, non-commercial use only. It may not be transferred, assigned, resold or used for bulk or commercial trade-ins.

4. Qualifying Purchase

4.1 A “Qualifying Purchase” is the purchase of a qualifying new device directly from O2 on an O2 Refresh contract during the Offer Period.

4.2 The Qualifying Purchase must be made through o2.co.uk, an O2 retail store or O2 telesales.

4.3 All devices available to purchase on O2 Refresh qualify for the Offer, subject to availability.

4.4 O2 Refresh consists of separate Device Plan and Airtime Plan agreements. The customer must meet the applicable eligibility and credit-check requirements. O2’s latest Pay Monthly tariff terms apply.

4.5 The Qualifying Purchase and related Qualifying Recycle must be completed as part of the same O2 purchase journey. An O2 Recycle order made separately through the standalone O2 Recycle website will not qualify.

4.6 If the Qualifying Purchase is cancelled, returned, rescinded or found to be fraudulent, O2 may withdraw the Promotional Trade-In Value or recover any promotional amount already paid or credited, to the extent permitted by law.

5. Qualifying Recycle

5.1 A “Qualifying Recycle” means registering an eligible device for trade-in through O2 Recycle as part of a Qualifying Purchase during the Offer Period, where:

a. the device has a trade-in value greater than £0;

b. the device is accurately identified and described during the O2 Recycle process;

d. the device is received by O2 Recycle within 14 days of the Qualifying Purchase; and

e. the trade-in is completed in accordance with these Terms and the O2 Recycle terms and conditions.

5.2 The device must pass the O2 Recycle checklist. Its final value will depend on its model, storage capacity, condition and functionality.

5.3 The Promotional Trade-In Value shown during the purchase journey is based on the information provided by the customer. O2 Recycle will inspect the device after it is received.

5.4 If the device received:

a. is not the device registered;

b. has a different storage capacity;

c. does not meet the condition described by the customer;

d. does not pass the O2 Recycle checklist; or

e. is subject to an account, security or ownership restriction,

O2 Recycle may revise or reject the valuation in accordance with the O2 Recycle terms.

5.5 Where a revised valuation is offered, the customer may accept or reject it in accordance with the O2 Recycle terms. The Promotional Trade-In Value will be recalculated, where applicable, by reference to the device and condition confirmed following inspection.

5.6 The O2 Recycle terms and conditions form part of this Offer and are available on the O2 Recycle terms and conditions page. The O2 Recycle terms may change from time to time.

6. Offer Period

6.1 The Offer begins at 08:00 on 22/10/2026 and ends at 00:00 on 06/01/2027, inclusive (the “Offer Period”).

6.2 The Qualifying Purchase and registration of the Qualifying Recycle must take place during the Offer Period.

6.3 The customer’s device must be received by O2 Recycle within the period specified in clause 5.1(d), even where that date falls after the end of the Offer Period.

6.4 Purchases made, or devices registered for trade-in, outside the Offer Period will not qualify.

7. How the Comparison Works

7.1 O2 works with Likewize, the provider that operates the O2 Recycle service, to obtain publicly available Standard Competitor Trade-In Values from EE, Vodafone,Three, Sky Mobile, ID Mobile and giffgaff.

7.2 Standard Competitor Trade-In Values are obtained once each working day, Monday to Friday from the publicly accessible online trade-in websites operated directly by EE, Vodafone,Three, Sky Mobile, ID Mobile and giffgaff. Competitor values are not monitored or updated on Saturdays, Sundays or bank holidays. Values displayed during those periods will be based on the most recent competitor pricing data obtained and processed by O2.

7.3 The competitor pricing data used to calculate the Promotional Trade-In Value may take up to 24 hours to be updated.

7.4 O2 will compare materially equivalent devices using the same:

a. manufacturer and model;

b. storage capacity;

c. device-condition category; and

d. functionality and other applicable valuation criteria.

7.5 O2 will identify the highest Standard Competitor Trade-In Value available from the Networks for the relevant eligible device using the most recent competitor pricing data processed by O2. O2 will then increase that value by £1 to calculate the Promotional Trade-In Value.

7.6 The comparison is made using the latest competitor pricing information available to and processed by O2 when the Promotional Trade-In Value is generated. Competitor trade-in values are subject to change after the relevant data has been obtained.

7.9 A comparison can only be made where:

a. the same device model and storage capacity is accepted by O2 Recycle and at least one Network;

b. materially equivalent device-condition criteria can be applied; and

c. O2 has obtained sufficient current information to make the comparison.

7.10 If O2 cannot identify a materially equivalent Standard Competitor Trade-In Value for a device, that device will not qualify for the Offer. The standard O2 Recycle value may still be available.

8. Customer Queries

8.1 If a customer believes that EE, Vodafone, Three , Sky Mobile, ID Mobile and giffgaff was offering a higher Standard Competitor Trade-In Value for the same device through a direct trade-in scheme when the customer made their Qualifying Purchase, the customer must contact O2 o2recycle.co.uk/contact-us within 14 days of the Qualifying Purchase and provide:

a. the customer’s O2 order number and O2 Recycle order number;

b. the competitor’s name;

c. the device model, storage capacity and stated condition;

d. the date and time the competitor value was available; and

e. clear evidence of the publicly available competitor value, such as a dated screenshot or link.

8.2 The competitor value must have been:

a. publicly available directly from EE, Vodafone, Three, Sky Mobile, ID Mobile and giffgaff;

b. available to the customer at the time of their Qualifying Purchase;

c. for the same device model and storage capacity;

d. based on materially equivalent device-condition criteria; and

e. a Standard Competitor Trade-In Value rather than an excluded promotional or enhanced value described in clause 2.4.

8.3 O2 will assess the information supplied against its records and the applicable Offer criteria. If O2 confirms that a higher qualifying Standard Competitor Trade-In Value was available, O2 will increase the customer’s Promotional Trade-In Value so that it exceeds that competitor value by £1/apply or pay the difference using the method notified to the customer.

8.4 O2 may request additional information reasonably required to verify the customer’s request. Screenshots that are incomplete, edited, undated or do not show the relevant device, value and provider may not be sufficient.

9. Payment or Credit

9.1 The Promotional Trade-In Value will be provided using the payment or credit method selected or made available through the O2 Recycle journey, subject to the O2 Recycle terms.

9.2 Where the Promotional Trade-In Value is applied as Device Plan credit, the credit will be applied against the customer’s Device Plan in accordance with the information provided during the purchase journey.

9.3 There may be a difference between the date on which the trade-in value is quoted, the date on which the device is inspected and the date on which payment or credit is applied. O2 is not liable for any changes to the trade-in value during this period.

10. Other Important Terms

10.1 O2 may refuse or withdraw the Offer from a customer where O2 reasonably believes that:

a. the customer has not complied with these Terms or the O2 Recycle terms;

b. false, inaccurate or misleading information has been supplied;

c. the Offer is being used fraudulently, abusively or for commercial purposes; or

d. the customer has attempted to manipulate the comparison or trade-in process.

10.2 O2 may suspend, amend or withdraw the Offer, or amend these Terms, where reasonably necessary because of circumstances outside O2’s reasonable control, to comply with applicable law or regulation, to prevent fraud or abuse, or where O2 can no longer obtain reliable competitor pricing data.

10.3 Where O2 amends or withdraws the Offer, this will not affect a customer who has already validly completed a Qualifying Purchase and registered a Qualifying Recycle before the amendment or withdrawal, except where a change is required by law or a regulatory authority.

10.4 O2 is not responsible for competitor websites, systems or services, or for changes made by a Network to its trade-in values, device criteria or availability.

10.5 To the fullest extent permitted by law, O2 will not be liable for any delay or failure caused by an event outside O2’s reasonable control. Nothing in these Terms excludes or limits O2’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded or limited.

10.6 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

10.7 These Terms, the O2 Recycle terms, the terms applying to the customer’s O2 Refresh contract and any applicable device or tariff terms together govern the Offer and the associated purchase and trade-in.

10.8 Nothing in these Terms affects the customer’s statutory rights.

11. Privacy and Data

11.1 O2 and its service providers may process personal data to administer the Offer, verify eligibility, manage the Qualifying Purchase and Qualifying Recycle, investigate customer queries and prevent fraud or abuse.

11.2 Personal data will be processed in accordance with applicable data protection law and O2’s Privacy Policy. Further information is available in the O2 Privacy Policy.

12. Governing Law and Jurisdiction

12.1 These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.

12.2 If the customer lives in England or Wales, the courts of England and Wales will have jurisdiction. If the customer lives in Scotland, they may bring proceedings in the Scottish or English courts. If the customer lives in Northern Ireland, they may bring proceedings in the Northern Irish or English courts.
