Priority Sports terms and conditions

1. For the purpose of these terms and conditions "We", "Us" and "Our" means Telefónica UK Limited of 500 Brook Drive, Reading, RG2 6UU. "You", or "Your" refers to You, the customer and user of the Priority Sports service. "Nike" means Nike European Operations Netherlands B.V. of Colosseum 1, 1213 NL Hilversum, The Netherlands. By using the Priority Sports app or registering for Priority Sports, or applying for a Priority Sports offer, You are deemed to have accepted these terms and conditions
2. Priority Sports is available as a native app on mobile phones with Android operating systems, or as a mobile web app on mobile phones with iOS. It is not available on any other operating system. Priority Sports is a service brought to You by Us, and can be based on Your location and the information we hold. If you have downloaded the Priority Sports app and wish to switch off location services, please change your settings on the app. If you have accessed Priority Sports through your mobile browser, the location service may run independently to your GPS settings on your mobile. If you do not wish for location services to be used on your handset, you are advised not to use Priority Sports through your mobile browser.
3. You agree that the information supplied by You to Us may be used by O2 or our agents for the following purposes which shall include but are not limited to: sending Priority Sports messages, monitoring the use of the service, and from time to time evaluating if we can improve the service for customers. Your information will be treated in accordance with O2's Privacy Policy, which can be viewed at http://www.o2.co.uk/privacy.html.
4. If You receive a message from Priority Sports that offers You the opportunity to browse and or call to learn more, depending on the mobile tariff You are on, charges may apply.
5. This is a UK - based service and we encourage you not to use it while you are roaming. If You are roaming when You receive a message from Priority Sports and You reply/call or browse, depending on the mobile tariff You are on, roaming charges will apply.
6. We reserve the right to make any changes to the Priority Sports service or to discontinue any aspect or feature of the service without notice to users. O2 may modify or withdraw Priority Sports or elements of it (including charges for the service) at any time. If we change these terms to Your significant disadvantage we will notify You.
7. We reserve the right to change these terms and conditions at any time. Your continued use of the Priority Sports service will be deemed to have accepted the varied terms and conditions which will be posted on www.o2.co.uk/termsandconditions.
8. Any use of the service by You is on an "as is" and an "as available" basis. You agree and accept that Priority Sports is not a fault-free service and is for Your own personal use and shall not be used for commercial purposes.
9. Any use of Priority Sports is entirely at Your own risk and in no event shall we be liable for any indirect, incidental or consequential damages including without limitation loss of income, data or other information as a result of the use of Priority Sports.
10. Priority Sports offers are subject to availability and may only be available while stocks last. We'll not be responsible if Your application for a Priority Sports offer is incomplete, lost or not received.
11. Links to third party websites and companies may appear on the service. Such third party websites are not the responsibility of O2 and We accept no responsibility for the availability, suitability, reliability or content of such third party websites.
12. Certain components of Priority Sports are supplied to Us by third parties and We cannot be held responsible for and do not accept any liability, either express or implied as to such components, including but not limited to their accuracy, relevance or quality.
13. You acknowledge and agree that We are not responsible for the availability of any third party products and services or what You access through Priority Sports. We shall not be held responsible or liable for any content, advertising, products or services available from such third parties. Any dealings between You and any other third party advertisers or merchants (including without limitation Nike) found on or via Priority Sports, including payment for and delivery of products, services and any other terms, conditions, warranties or representations associated with such dealings, are made between You and the relevant advertiser or merchant. Therefore, We are not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings.
14. O2 accepts no liability or responsibility for any of the third party bookings, products and services provided by Nike or third party suppliers. Nike and the third party suppliers will be supplying products and services to You on the terms and conditions agreed between You and Nike or the third party supplier, as the case may be. Please note that third party offers may be withdrawn or amended at any time.
15. Priority Sports, its features and material and content within Priority Sports may also be protected by intellectual property rights and other rights belonging to O2, Nike, its licensors or to third parties. No licence is granted to You in respect of any such rights, except to the extent required for Your personal use of Priority Sports in accordance with these terms and conditions. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the features, materials or content of Priority Sports. Without limiting the foregoing, O2 and any other O2 product or service name are trade marks of O2 and You shall not be entitled to reproduce such marks without our prior written consent, and Nike, Nike+ and any other Nike product or service name are trade marks of Nike and You shall not be entitled to reproduce such marks without Nike's prior written consent.
16. You acknowledge and agree that Nike, Inc. and its affiliates (collectively, the "Nike Group") are not responsible or liable for Priority Sports, including the availability of Priority Sports. The Nike Group shall not be held responsible or liable for any offers, content, advertising, products or services available from O2 or any other third parties, including their availability, suitability or reliability. Any dealings between You and O2 or other third party, and any other terms, conditions, warranties or representations associated with such dealings, are made between You and O2 or the relevant third party. Therefore, the Nike Group is not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings.
17. You acknowledge that Nike-supplied content, services, products and offers are provided on an "as is" and an "as available" basis, and are not fault free. You agree that any use of Nike-supplied content, services, products and offers are entirely at Your own risk and in no event shall Nike be liable for any indirect, incidental or consequential damages, including, without limitation, loss of income, data or other information as a result of the use of Nike-supplied content, services, products and offers.
18. Nike-supplied offers are subject to availability and may only be available while stocks last. Nike will not be responsible if Your application for a Nike-supplied offer is incomplete, lost or not received.
19. You acknowledge that in order to access certain Nike-supplied content, services, products and offers, you must accept additional terms and conditions and the Nike Privacy Policy. In particular, the purchase of Nike products is subject to Nike Retail B.V.'s terms and conditions for online purchasing, available at www.nikestore.com, where You can also find contact details for the Nike Support Team. Nike Retail B.V. is a company incorporated under the laws of the Netherlands with its registered office at Colosseum 1, 1213 NL Hilversum, The Netherlands.
20. These terms and conditions are governed by English Law and You and We submit to the non exclusive jurisdiction of the English Courts.
