O2 More Terms & Conditions (archived version  to 24 Mar 15)

  1. For the purpose of these terms and conditions (which are in addition to the standard airtime contract terms and conditions and the O2 Web and WAP services terms found at which shall govern the use of your O2 service ("Service")), "We", "Us" and "Our" means Telefónica UK Limited of 260 Bath Road, Slough, Berkshire SL1 4DX. "You", or "Your" refers to you, the customer and user of the O2 More service. By using O2 More you are deemed to have accepted these terms and conditions.
  2. We are the promoter of O2 More, a permission-based marketing and Information service by us to you ("O2 More"), based on preferences selected by you and the information we hold.
  3. Access to O2 More is only open to O2 users aged 16 years or over who have registered to opt in to receive O2 More messages. Certain offers shall only be available to users aged 18 or over. You hereby warrant that all information submitted by you to us is accurate and current. We reserve the right to verify the eligibility of users.
  4. You agree that the information supplied by you on registration and when selecting preferences for O2 More may be used by O2 or our agents for the following purposes which shall include but are not limited to: sending you O2 More messages, monitoring the use of the service, from time to time evaluating if we can improve the service for customers. Your information will be treated in accordance with our Privacy Policy, which can be viewed at privacy policy.
  5. You can subscribe to O2 More by going onto the website /o2more or by texting your postcode to 2011.
  6. If you receive a message from O2 More that offers you the opportunity to browse and or call to learn more, depending on the mobile tariff you are on, charges may apply.
  7. If you are roaming when you receive a message from O2 More and you reply/call or browse, depending on the mobile tariff you are on, roaming charges may apply.
  8. You may receive offers that are based on your individual phone location. To opt out of receiving such offers, text 'stop' to 20509.
  9. O2 may modify or withdraw O2 More or elements of it (including charges for the service) at any time. If we change these terms to your significant disadvantage we will notify you by text message 30 days in advance.

  11. Any use of the service by you is on an "as is" and an "as available" basis. You agree and accept that O2 More is for your own personal use and shall not be used for commercial purposes.
  12. O2 More and features within O2 More may also be protected by intellectual property rights belonging to O2, its licensors or to third parties. No licence is granted to you in respect of any such rights, except to the extent required for your personal use of O2 More in accordance with these terms and conditions. O2 and any other O2 product or service name are trade marks of O2 and you shall not be entitled to reproduce such marks (other than to the extent required for your personal use of the O2 Service) without our prior written consent.
  13. Components of O2 More are supplied to us by third parties and We cannot be held responsible for and do not accept any liability, either express or implied as to such components, including but not limited to their accuracy, relevance or quality.
  14. Any use of O2 More is entirely at your own risk and in no event shall we be liable for any indirect, incidental or consequential damages including without limitation loss of income, data or other information as a result of the use of O2 More.
  15. To opt out of O2 More send "STOP" to 20502 via SMS. It can take up to one week to opt out of O2 More from the time you send the SMS. You will receive a text message to confirm when your request to opt out has been processed.
  16. You acknowledge and agree that We are not responsible for the availability of any third party Websites or material you access through O2 More. We do not endorse and shall not be held responsible or liable for any content, advertising, products or services on or available from such Websites or material.
  17. Any dealings between you and any third party advertisers or merchants found on or via the O2 More Site, including payment for and delivery of products, services and any other terms, conditions, warranties or representations associated with such dealings, are made between You and the relevant advertiser or merchant. Therefore, We are not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings.
  18. O2 accepts no liability or responsibility for any of the third party bookings, products and services provided by third party suppliers. The third party suppliers will be supplying products and services to you on their own standard terms and conditions. Please note that third party offers may be withdrawn or amended at any time.
  19. On average you will receive up to 6 O2 More messages by SMS per week although the number of O2 More messages sent will be entirely at O2's discretion (based on preferences selected by you and the information we hold). O2 cannot commit to sending a minimum number of messages, particularly if you would like to hear about offers in your location. You may also receive a weekly newsletter by email setting out our star offers; you can unsubscribe from receiving this email.
  20. These terms and conditions are governed by English Law and you and we submit to the non exclusive jurisdiction of the English Courts.
