The Promoter

1. The Promoter is O2

Promotion Period

2. The Promotion will commence at 00:01 (GMT) on 19 May 2016 and shall close at 23:59 (GMT) on 08 June 2016 (the "Promotion Period").                              

Eligibility

3. To be eligible to participate in the Promotion you must be a UK resident aged 18 years or over.
4. This Promotion is available only to consumers (i.e. not to any business or reseller).
5. Employees or agents of the Promoter are not eligible to participate.

Offer

6. Participants who purchase a new (i.e. not second hand or refurbished) Galaxy S7 or S7 Edge (each a "Promotion Product" and together the "Promotion Products") from a participating O2retailer, call centre or online during the Promotion Period will be entitled to 50% off the purchase of Gear VR, plus Free Oculus content worth over £40 (the "Gift").

7. O2 Hardware Redemption T's and C's:

This promotion to the Samsung Gear VR Goggles (the "Goggles") for a reduced price when bought with a selected device on O2 Refresh (the "Promotion") is being promoted by Telefónica UK Limited having its registered office at 260 Bath Road, Slough SL1 4DX ("O2"). Please read the following terms and conditions carefully. These terms and conditions govern the Promotion.

 

• The  Promotion is open to UK residents over the age of 18
• Provided you (hereinafter "you" or the "Participant") complete a valid purchase of a Samsung S7 or S7Edge, (each a "Device") from O2 Stores, Telesales or www.o2.co.uk on a 3GB or above O2 Refresh tariff you will be entitled to purchase the Samsung VR Goggles ("The Goggles") for £40.00 subject to availability and while stocks last.
• O2 Refresh terms and eligibility criteria apply. See o2.co.uk/terms.
• You must purchase the Goggles in an O2 store, O2 Telesales or online at the same time as you purchase your Device.  Failure to purchase simultaneously with the Device will result in you not being eligible for the discount and if purchased separately you will have to pay the full price for the Goggles.
• The Promotion will run in O2 stores, o2.co.uk and O2's telesales only from 19^th May - 8^th June 2016(the "Promotion Period"). O2 reserves the right to extend or shorten the Promotion Period at any time. 
• In the event of cancellation or return of your Device or contract under O2's Change of Mind period, you must also return the Gear VR.
• Participants must retain their receipts as proof of purchase. 
• O2 reserves the right to substitute the reduced price Gear VR for an alternative of equal or greater value. This decision will be final and no correspondence will be entered into.
• For the avoidance of doubt, the Promotion only includes the Gear VR and there will be no cash or other alternatives.
• O2 reserves the right to withdraw or amend the Promotion at any time on reasonable notice.
• If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
• The Promotion is governed by English Law and is subject to the exclusive jurisdiction of the English courts.

8. To redeem the Oculus content bundle ("Oculus Content"), you must first purchase an eligible Samsung product in accordance with the terms communicated by Samsung ("Eligible Product"). You will need to download the Oculus app and activate your Oculus account (if you do not already have an Oculus account) on your Eligible Product prior to using downloading and accessing the Oculus Content. Redemption and use of Oculus Content is subject to all applicable Oculus policies in connection with your Oculus account or as presented to you at the time of account registration/activation. Valid Oculus account in good standing is required to redeem Oculus Content. If you do not already have an Oculus account, you will be required to sign up through the Oculus Store to redeem the Oculus Content. There is no charge associated with obtaining or activating an Oculus account. The Oculus Content must be downloaded prior to 11:59:59 pm [local time] on July 11, 2016 or within 30 days of receiving your Eligible Product, whichever is later. Any attempt to redeem the Oculus Content entered after this time will not be valid. If properly redeemed, the Oculus Content will be available based on your Eligible Product through your Oculus account. Approximate retail value of Oculus Content: EUR€50. Oculus Content titles will be determined in Oculus's sole discretion; no substitutions permitted. May not be redeemed for cash; no cash value. Open to residents of UK only who are the age of majority in their jurisdiction of primary residence. This offer may be redeemed a limit of one (1) time per Eligible Product purchased. Offer is void: where prohibited, restricted or taxed; if altered, transferred, purchased, or sold; and if offer is not redeemed through legitimate channels or if any offer-related materials are counterfeit, altered, defective, tampered with or irregular in any way. Redemption subject to review and verification. Other restrictions may apply. Oculus VR, LLC may amend, suspend or terminate this portion of the offer at any time without prior notice or consent. All redemptions of Oculus Content are final. Any questions relating to redemption of the Oculus Content will be resolved in Oculus's sole discretion and their decisions will be final and binding with respect thereto.
9. Offer running whilst stocks last.Claim
10. A maximum of one Gift per qualifying Promotion Product purchased ("Claims").
11. To claim the Gift, Participants must purchase a Promotion Product together with a Gear VR device during the Promotion Period, at one of the O2 retailer, call centre or online.
12. To access the free content, consumer will need to attach the Promotion Product to their Gear VR headset, download the Gear VR app, and register an account with Oculus. Consumer will then be prompted to download the free games on the Oculus store.
13. Consumers must download the free content before 11^th July 16 as the free content package offer will expire 30 days after the end of the promotion period.
14. Not valid in conjunction with any other offer or discount.
15. Your download, installation and use of the gaming applications and service are governed by Samsung Galaxy Apps terms of use, license agreement, privacy policy or other such agreements.
16. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to proof of purchase, as well as the identity, age, and other relevant details of a participant.
17. A claim must be made by the participant and must not be made through agents or third parties.

Privacy and Data Protection

18. The Promoter may use any personal information submitted by the participant to advise participants of future promotions and to provide information about products of the Promoter or its associated companies that may be of interest. The participant hereby consents to such personal information being used for this purpose and confirms that it agrees with the Promoter's privacy policy available at: www.samsung.com/uk/info/privacy.html. The participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter's privacy policy.
19. Other than as set out in these terms and conditions or for the purposes of operating the Promotion, the details and information provided by the participant when entering the Promotion or claiming the Reward will not be used for any promotional purpose, nor shall they be passed to any third party.

General

20. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter's control.
21. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.
22. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or claims; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.
23. Participants will be solely responsible for any and all applicable taxes and any other relevant costs or expenses which are not stated in the Terms and Conditions as included in this Promotion.
24. By participating in this Promotion, you agree, to the maximum extent permitted by applicable laws, to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Gift. The above limitation of liability shall not apply to death or personal injury caused as a result of Promoter's negligence.
25. The Promotion is governed by English law.
