O2 Christmas Gift with Selected Purchases Offer - Terms and Conditions

This promotion offers you the opportunity to get one (1) of five (5) gifts (“Free Gifts”) when you buy selected devices directly from O2 (the “Offer”). The Offer is being promoted by Telefónica UK Limited having its registered office at 260 Bath Road, Slough SL1 4DX ("O2"). Please read the following terms and conditions carefully. These terms and conditions govern the Promotion.

Eligibility & Participation

1. This promotion is open to new and upgrading customers (“Eligible Customers”).
2. To participate Eligible Customers must make a Qualifying Purchase. A “Qualifying Purchase” is the purchase of an Eligible Device directly from O2 stores (including franchise stores), online at o2.co.uk or through our O2 Telesales between 10 November 2016 and 21 December 2016 (“Offer Period”). Devices are listed in Annex 1 and where the device is a Pay Monthly device, it must be purchased with an O2 Refresh 24-month credit agreement and Airtime Plan with a standard data tariff of 1GB or more for phones and a standard data tariff of 2GB or more for tablets to be eligible. Phones with standard Pay Monthly tariffs of 1GB or more are also eligible (each an “Eligible Device”).
3. Purchases made through a third party distributor are excluded and will not qualify for this Offer.

Free Gift

4. Eligible Customers who make a Qualifying Purchase (a “Participant”) will be can claim one of the free gifts listed in paragraph 5 below (“Free Gift”), subject to availability at the point of redemption.
5. One Free Gift per Qualifying Purchase.
6. Participants will have the opportunity to choose one of the following Free Gifts, subject to availability and acceptance of additional terms or eligibility criteria that may apply to each respective Free Gift:

      v. Digital codes to redeem 2 x ODEON cinema tickets for Rogue One: A Star Wars Story and a medium-scooped popcorn. This Gift requires acceptance of additional Ticket & Popcorn Offer terms including ODEON venue user terms and conditions and eligibility criteria. Digital Codes must be redeemed by 28 February 2017 after which they will expire.

7. Free Gifts are subject to availability and whilst stocks last. O2 provides no guarantee that all Free Gifts will remain available for selection throughout the Offer Period. O2 reserves the right to amend this promotion at any time which may include the substitution of any of the Free Gifts for a suitable alternative
8. Once a Participant has selected the Free Gift this selection cannot be altered.
9. Participants can claim their Free Gift no earlier than five (5) days after they have made their Qualifying Purchase, but before vouchers expire. Free Gifts must be claimed by 31 January 2017.
10. To claim the Free Gift, Participants must follow instructions provided on the voucher leaflet included with their Qualifying Purchase, go to https://www.o2-gifts.co.uk (the “Redemption Site”) and enter the unique code printed on the voucher leaflet and the IMEI device code.

Other important terms

11. Where a Particpant wishes to cancel their Qualifying Purchase, (including O2 Refresh Device Plan and associated Airtime Plan if applicable) within the 14 day Change-Your-Mind period then they are no longer eligible to participate in this Offer. Participants must return the “Free Gift” voucher, with the code panel unscratched and undamaged, when they return their Eligible Device. Participants who have already received their Free Gift must return the Gift with the Eligible Device. Participants who selected the DisneyLife 6-month Gift Membership may have their membership cancelled from the date that their Qualifying Purchase is cancelled. 12. No applications from organised groups, third parties, or agents, will be allowed. Incomplete applications or applications that are not in accordance with the application instructions will be rejected.
12. We will aim to send your Free Gift within the time period stipulated on the dispatch note provided to you at time of application.
13. Entitlement to the Free Gift is personal to the Participant and cannot be transferred, unless otherwise permitted by the Promoter Redemption Partner of the Free Gift. The voucher for the Free Gift has no monetary value and cannot be exchanged for cash.
14. Responsibility is not accepted for applications damaged, lost, or delayed as a result of any computer hardware, network or software failure of any kind. Damaged to or loss of voucher may result in the Eligible Customer being unable to claim the Free Gift.
15. Applicants should retain a copy of their receipt as proof of purchase.
16. In the event of unforeseen circumstances the Promoter reserves the right to substitute the Free Gift for an alternative of equal or greater value. In the event of any dispute the decision of the Promoter is final. No correspondence will be entered into.
17. By participating in the promotion, all applicants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this promotion and any other purposes to which the entrant has consented. Where the Free Gift chosen is the Disney Life subscription and or free cinema tickets then Eligible Customer also consents to the transfer of their personal data to the provider of those Free Gifts. 18. These terms and conditions shall be governed by English law and the English courts shall have exclusive jurisdiction.

SCHEDULE 1 - Additional Offer Term for DisneyLife 6-Month Gift Subscription Free Gift

The following terms apply if you have selected the DisneyLife 6- month membership as your Gift from O2

Eligibility:

1. To be eligible for the 6-month DisneyLife gift membership (“Gift Membership”) you must have made a qualifying purchase in accordance with O2’s Christmas Gift Terms and Conditions and selected the Gift Membership as your chosen gift.
2. Only new DisneyLife members are eligible. You are welcome to claim this offer and transfer the gift to a family member or friend (you may not sell the gift).
3. You must be over 18 and a UK resident.

Gift Membership

4. The gift entitles you to one 6 month DisneyLife membership.
5. At the end of the gift membership you (or your family member or friend) will be invited to continue and pay for access at the then current subscription fee.

How to Redeem

6. You can only claim this offer via O2 by following the instructions provided to you on the voucher enclosed with your O2 purchase.
7. You must claim the offer before 31st January 2017.
8. The gift code will be sent to you so that you (or your family member or friend) can redeem the offer on the DisneyLife website. You (or your family member or friend) will be asked to login or sign up for a Disney Account (including acceptance of the DisneyLife Terms of Use at www.disneylife.com/terms) and a valid credit/debit card details will be taken to authenticate that the new member lives in the UK. The credit/debit card will not be charged. The gift membership will then start immediately and the new member will be invited to download the DisneyLife App to access all the benefits of the service.
9. The gift code must be activated on or before 28 February 2017, after this date all codes automatically expire. Expired codes and cannot be exchanged or renewed.
10. In order to provide you with this offer, O2 may share your information with Disney, in accordance with O2’s Privacy Policy.

Compatibility

11. The DisneyLife App is compatible with Apple iPhone and iPads running iOS8.0 or later and Android devices running Android 4.3 or later. Access to the DisneyLife service through the web is limited to Movies and TV box sets only. No mobile web browser playback experience available. 12. This offer cannot be used in conjunction with any other offer (including a free trial), promotional code, gift code or voucher. The offer code has no cash or refund value (except when redeemed in accordance with all terms and conditions of this offer) and is not for resale.

The following terms apply if you have selected the Rogue One: A Star Wars Story - Cinema Ticket Package as your Free Gift from O2.

Ticket Codes

1. One ticket code can be redeemed for one 2D or 3D adult or child ticket to see Rogue One: A Star Wars Story only. Ticket code is valid on screenings from 15th December 2016 until 28th February 2017 (inclusive) only.
2. Ticket code can be redeemed online as a promotional code on the payment page at www.ODEON.co.uk or on the ODEON app. To redeem your ticket code in cinema, please show the ticket code on your phone or print out your email with the ticket code. Ticket codes cannot be redeemed at the ticket machine.
3. Ticket code is valid for Premier seats but not D-box seats, Love seats, club seats or super luxury seats.
4. Ticket code is not valid on IMAX, iSense or Gallery.
5. Ticket code is not valid on Family tickets.
6. Ticket code is not valid for ODEON Newbies, ODEON Kids, ODEON Silver Cinema, ODEON Event Cinema or ODEON Screen Unseen. Not valid on premieres, special events or screenings or events not open to the public.
7. Ticket code is valid at all ODEON cinemas in the UK except ODEON Leicester Square, BFI IMAX and The Lounge at Whiteleys.
8. Ticket codes can only be used once and is valid for one person only.

Simply show your code on your phone at the retail counter or print out the email containing your popcorn code.
2. Popcorn code cannot be used online.
3. Popcorn code is not valid on bagged popcorn, combos, Kids Mix or any mix and match deals.
4. Popcorn code is valid at all ODEON cinemas in the UK except ODEON Leicester Square, BFI IMAX and The Lounge at Whiteleys.
5. Popcorn code can only be used once.
6. Guest will earn ODEON Première Club points at the discounted price paid.
