Charge to Mobile iTunes Christmas 2014 Offer terms and conditions

  1. This offer is only available for O2 customers who choose to purchase a £30 iTunes Code from o2.co.uk, using the 'Charge to Mobile' payment option from the 21th December to 28 December 2014. Offer not available in stores or other sales channels or to any other methods of payment. Offer is not promoted by Apple.
  2. Customers can buy a maximum of 3 discounted iTunes Codes per mobile number during the above stated promotional period. Customers are limited to purchasing one iTunes Code for themselves and two for gifting, to separate email addresses.
  3. Under this offer, if you successfully complete a 'Charge to Mobile' purchase for a £30 iTunes Code, you will receive a £5 discount. Discount will be applied at the checkout.
  4. For the avoidance of doubt, the Offer applies to the £30 iTunes Code only and not to any other iTunes Code value (higher or lower than £30) or to multiple of iTunes Codes, even if their sum total equals £30.
  5. Participants should select the 'Charge to Mobile' payment option and follow the given instructions. Details of your iTunes Code and how to redeem it will be emailed to you following successful payment.
  6. 'Charge to Mobile' means that the cost of the iTunes Code will be added to your O2 mobile phone bill (if Pay Monthly) or deducted from your credit (if Pay & Go). Pay & Go customers must have sufficient credit on their account for the payment and voucher purchase to be completed successfully. Daily spend limits and other conditions of using the 'Charge to Mobile' method of payment may apply. Purchases using other payment methods are excluded.
  7. To take up this Offer you must be the bill-payer or have the bill-payer's permission to make this 'Charge to Mobile' purchase.
  8. iTunes Codes are for use in the UK iTunes Store, App Store, iBooks Store and Mac App Store only, and are compatible with iTunes for Mac or PC.
  9. iTunes Codes must not be re-sold. Other iTunes Codes terms may apply.
  10. This offer is subject to availability, is non-transferable and no cash or other alternatives are available.
  11. This offer cannot be used in conjunction with other offers or promotions.
  12. O2 reserves the right to end or amend this offer in future.
  13. O2 accepts no responsibility for incorrectly completed, lost or delayed claims, notices, acceptances, tickets or other documents related to the reward.
  14. In the event of fraud, abuse, and/or an error affecting the proper operation of this promotion, and where circumstances make this unavoidable, O2 reserves the right to end or suspend the promotion; amend these terms & conditions; and / or declare void the notification of customers, but will always endeavour to minimize the effect to claimants in order to avoid undue disappointment.
  15. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
  16. Customers' data will be collected, stored and processed for the purposes of administering and assessing this promotion. For the purpose of administering the reward, O2 reserves the right to exchange information and data regarding applications with service providers.
  17. In relation to the promotion, O2's decision is final in all promotional matters.
  18. Owing to circumstances outside its reasonable control and only where circumstances make this unavoidable, O2 reserves the right to suspend, cancel or amend the promotion and/or review and revise these terms and conditions at any time without giving prior notice and by continuing to take part in the promotion subsequent to any revision of these terms and conditions, entrants shall be deemed to have agreed to any such new or amended terms.
  19. Where circumstances make this unavoidable, O2 shall not be liable for any failure to fulfil this offer where such failure is caused by any supervening circumstances amounting to force majeure. Such circumstances shall include, but shall not be limited to, postal strikes, terrorist attacks, website malfunction, adverse weather conditions, acts of God, economic crisis or network malfunction.
  20. No responsibility will be accepted for any difficulties in claiming or any claims delayed or corrupted. O2 will have no liability for any loss arising out of such an event.
  21. O2 may at its absolute discretion disqualify any claims which O2 reasonably feels do not comply with these terms and conditions, or where any form of bad faith is suspected or where the spirit of the promotion has been compromised. All claims will be validated.
  22. Participants of the Promotion agree to be bound by these terms and conditions. The Promoter reserves the right at its sole discretion to disqualify any participant found to be abusing or tampering with the operation of the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of the terms and conditions. The Promoter reserves the right at any stage to verify any entrant's details including but not limited to name, age and address.
  23. This promotion is governed by English Law and is subject to the exclusive jurisdiction of the English and Welsh courts.
