Rose Army Terms and Conditions

The "Rose Army" campaign intends to find some of the most passionate England rugby fans and get them involved in a series of challenges to be displayed via social media and other digital platforms (the "Campaign"). The Campaign is run by Telefónica UK Limited having its registered office at 260 Bath Road, Slough SL1 4DX ("O2"). The following terms and conditions apply to Campaign participants.

  • 1. The Campaign is open to all UK residents over 18, including employees of O2, or any of its subsidiary companies, their families, agents or anyone else connected with the Campaign.
  • 2. O2 reserves the right to verify the eligibility of entrants. O2 may require such information as it considers reasonably necessary for the purpose of verifying the eligibility of an entry and entry into the Campaign may be withheld until and unless O2 is satisfied with the verification.
  • 3. The Campaign will run from 7th August 2015 - 30th November 2015 (the "Campaign Period"). O2 reserves the right to extend or shorten the Campaign Period at any time.
  • 4. One hundred (100) Rose Army members will be recruited for the Campaign (hereinafter "you" or a "Rose Army Member").
  • 5. The selection of the Rose Army Members is entirely subject to O2's discretion.
  • 6. Your will be contacted to confirm your participation in the Campaign. If you have not confirmed your participation within seven (7) days of being contacted, O2 reserves the right to select another Rose Army Member in its sole discretion.
  • 7. You must have an active Twitter account to participate in the Campaign.
  • 8. Rose Army Members will be asked to complete various support and rugby related challenges during the Campaign Period which will be explained in a private Facebook group that each Rose Army Member will be invited to join (the "Activities").
  • 9. O2 will work with Seven League Limited who will contact Red Army Members to confirm their participation in the Campaign and to communicate the Activities.
  • 10. All actions and comments made by Rose Army Members as part of the Activities are their own and are not endorsed by O2.
  • 11. O2 will not be liable for any damage, injury, or loss which you may suffer as a result of my participation in the Activities (to the fullest extent permitted by law).
  • 12. As part of the Activities you may be asked to record and post content on social media platforms (the "Content"). Any Content that you record, post, submit or make available for the Campaign:
    • - must not comment or be related to symbols, statements or words that are offensive to the general public or to individuals of a particular socioeconomic group, sexual orientation, ethnicity, race or religion;
    • - must not breach any laws or network standards;
    • - must not include any threats to any third parties;
    • - invade the privacy or any rights of any other person or entity;
    • - must be original and not contain and/or infringe any third party content, or third party intellectual property rights;
    • - must not draw an association with or reference to the 2015 Rugby World Cup (as described in more detail in clause 20 below); or
    • - must not contain anything unlawful, inappropriate, discriminatory, defamatory, obscene or indecent, including without limitation any material that would be criminal activity, or give rise to civil liability or breach any law ("Inappropriate Content").
  • 13. O2 reserves the right to exclude you from the Campaign if you submit or post Inappropriate Content or content contrary to clause 11 above.
  • 14. O2 further reserves the right to remove you from the Campaign in its sole discretion for reasons including but not limited to damage to O2's brand and/or reputation.
  • 15. O2 does not claim to own the Content and you will continue to own all rights in the Content. You will have the right to use the Content in any way you choose. However, by submitting or making available the Content as party of the Activities you agree to grant O2 a perpetual, royalty-free, irrevocable, sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, make available to the public, and exercise all copyright and publicity rights with respect to the Content worldwide and/or to incorporate the Content in other works in any media now known or later developed for the full terms of any rights that may exist in the Content as O2 may require. By submitting or making available the Content to O2, you also agree to waive all moral rights in the Content. O2 may (without notice to you) grant the same or other rights in respect of the Content to third parties without payment which may include the right to see and sell, distribute or otherwise publish the Content.
  • 16. To the extent permitted by law, O2 shall not be liable for any special, indirect, incidental, consequential or other damages related to any Inappropriate Content.
  • 17. You will indemnify and hold harmless O2 from any and all claims, liabilities, and damages on account of O2's use of the Content during the Campaign and/or any Inappropriate Content.
  • 18. You understand and accept that O2 may be taking photographs and/or video footage of you for the purposes of the Campaign (the "Footage"). You give your consent for O2 to take and use the Footage freely. You consent to O2 using the Footage anywhere in the world. O2 may use the Footage for commercial or non-commercial purposes, in any media format (whether known now or yet to be invented). Typical media formats include: (i) in O2's printed publications, presentations, promotional materials, internal and external communications, (ii) in the advertising of O2's goods or services, or (iii) on O2's website. You understand and accept that other media formats other than those listed may be used. You agree that O2 may use the Footage in its original format or edited or altered in any way which O2 deems appropriate. You consent to O2 storing copies of the Footage, or your contact details, on its database. You also consent to O2 transferring or storing the Footage, and your contact details outside of the European Economic Area.
  • 19. You will not receive any payment or other consideration for the Campaign, the Activities, any Content or Footage.
  • 20. O2's decision is final and no correspondence will be entered into in relation to any decision of O2 relating to the Campaign.
  • 21. The Campaign is in no way sponsored, endorsed or administered by, or associated with Twitter, Facebook, England Rugby, World Rugby Limited or Rugby World Cup Limited and you agree not to draw an association between yourself, the Campaign, and the 2015 Rugby World Cup when partaking in the Campaign. This will include, but not be limited to:
    • - no use of the terms: (i) World Cup, (ii) RWC, (iii) England 2015, (iv) England Rugby 2015, and (v) World Cup Rugby;
    • - no reproduction of Rugby World Cup fixture lists or tournament schedules; and
    • - no use of Rugby World Cup imagery, trade marks, or other content.
  • 22. If you have any doubt regarding what you should and should not post please contact O2.
  • 23. O2 will not be responsible for any inability of any Rose Army Member to take part in an Activity or any specified event or challenge.
  • 24. Unless otherwise expressly stated, any attendance at a specific venue or event, you will be solely responsible for travel to and from the venue and all other expenses. O2 assumes no responsibility and is not liable for any costs, charges or expenses which you may be required to pay at any time in connection with the Campaign.
  • 25. O2 reserves the right to suspend, cancel or amend the Campaign and/or review and revise these terms and conditions at any time without giving prior notice and by continuing to take part in the Campaign subsequent to any revision of these terms and conditions, you shall be deemed to have agreed to any such new or amended terms.
  • 26. You may be required to participate in publicity connected with the Campaign and it is a condition of entry that you agree to your Twitter name, name and country of residence being made publicly available.
  • 27. Data collected in relation to the Campaign will be used in accordance with O2's Privacy Policy.
  • 28. You also consent to O2 sharing your name and contact details with the Rugby Football Union of Rugby House, Twickenham Stadium, 200 Whitton Road, Twickenham, Middlesex, TW2 7BA for the purposes of the Campaign.
  • 29. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
  • 30. The Campaign is governed by English Law and is subject to the exclusive jurisdiction of the English courts.
