O2 Academy Terms And Conditions

  1. For the purpose of these terms and conditions "O2", "We", "Us" and "Our" means Telefonica UK Limited of 260 Bath Road, Slough, Berkshire SL1 4DX. "You", or "Your" refers to You, the customer and user of the application ("the O2 Academy App" or the "App").
  2. By using the App, You are deemed to have accepted these terms and conditions. "Mobile device" means portable devices with restricted screen size which are able to access the App via an over-the-air cellular network data connection, but also permitting access via Wi-Fi.
  3. 3. The "Territory" for use of the App means the United Kingdom of Great Britain, Northern Ireland, the Channel Islands and the Isle of Man. Yes

You will need to have access to a suitable mobile device and access or a subscription to a service, including data services, in order to access and use the App. These terms do not cover the provision of basic equipment or services necessary to obtain access to the internet or to connect to the App. Only mobile devices that are supported by the App may be used to access the App and you agree that O2 has no obligation to support any particular make or model of mobile device, whether or not such make or model is currently, or was previously supported by O2. The phones which currently support the App are the iPhone 5, iPhone 4S, IPhone 3GS, Samsung Galaxy SIII and Samsung Galaxy SII. It works on the following operating systems: iOS 7.0, iOS 6.1.3, 4.1.2 (JellyBean), 2.3.7 (Gingerbread). This list will be updated if the App becomes available on more handsets or operating systems and can be viewed at www.o2.co.uk/apps/o2-academy
  5. You agree to provide true, current and complete information about yourself as prompted by Us and to promptly update the information that you provide to Us from time to time in order to keep it true, current and complete. If we have reasonable grounds to suspect that any information that you have provided to Us is in fact untrue, inaccurate or incomplete, we may suspend or terminate your access to the App. If any of the information that you give to Us when you register changes you must inform Us immediately.
  6. You are hereby warned that the App uses the data connection of your mobile phone. If you do not have a proper mobile data plan, you can be charged for all data use by your mobile phone carrier. While many mobile phones automatically disable data usage when roaming (using your mobile phone outside your country or covered area of your carrier), if the data connection is active and you use the App while roaming, it can and will result in even higher charges, often regardless of regular unlimited mobile data plans. We are in no way responsible or liable, for any or all charges you receive from your mobile phone carrier, by using the App. You are hereby warned that the App is intended for use with your own mobile phone carrier in which you subscribed to the service.  The App makes no warranty regarding correct operation whilst your device is connected to other carriers.
  7. If we have reason to believe that there has been or is likely to be a breach of security or any other misuse of the App we may suspend your service. We are not obliged to monitor, detect or report any unauthorised use of the App and you shall be solely responsible and liable for all user charges that are incurred on your account as a result of any such unauthorised use.
  8. You agree that the information supplied by You to Us may be used by O2 or our agents for the following purposes which shall include but are not limited to: sending in App messages, monitoring the use of the service, and from time to time evaluating if we can improve the service for customers. Your information will be treated in accordance with O2's Privacy Policy, which can be viewed at http://www.o2.co.uk/termsandconditions/privacypolicy.html.
  9. We reserve the right to make any changes to the App service or to discontinue any aspect or feature of the service without notice to users. O2 may modify or withdraw the App or elements of it (including charges for the service) at any time. If we change these terms to your significant disadvantage we will notify You.
  10. We reserve the right to change these terms and conditions at any time. Your continued use of the App service will be deemed to have accepted the varied terms and conditions which will be posted on www.o2.co.uk/termsandconditions.
  11. Any use of the service by You is on an "as is" and an "as available" basis. You agree and accept that the App is not a fault-free service and is for Your own personal use and shall not be used for commercial purposes.
  12. Any use of the App is entirely at Your own risk and in no event shall we be liable for any indirect, incidental or consequential damages including without limitation loss of income, data or other information as a result of the use of the App.
  13. App offers are subject to availability and may only be available while stocks last. We'll not be responsible if Your application for anApp offer is incomplete, lost or not received.
  14. Links to third party websites and companies may appear on the service. Such third party websites are not the responsibility of O2 and We accept no responsibility for the availability, suitability, reliability or content of such third party websites.
  15. Certain components of the App are supplied to Us by third parties and We cannot be held responsible for and do not accept any liability, either express or implied as to such components, including but not limited to their accuracy, relevance or quality.
  16. You acknowledge and agree that We are not responsible for the availability of any third party products and services or what You access through the App. We shall not be held responsible or liable for any content, advertising, products or services available from such third parties. Any dealings between You and any other third party advertisers or merchants found on or via the App, including payment for and delivery of products, services and any other terms, conditions, warranties or representations associated with such dealings, are made between You and the relevant advertiser or merchant. Therefore, We are not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings.
  17. The App, its features and material and content within the App may also be protected by intellectual property rights and other rights belonging to O2, its licensors or to third parties. No licence is granted to You in respect of any such rights, except to the extent required for Your personal use of the App in accordance with these terms and conditions. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the features, materials or content of the App. Without limiting the foregoing, O2 and any other O2 product or service name are trade marks of O2 and You shall not be entitled to reproduce such marks without our prior written consent.
  18. The App interacts with other online applications and websites. As such the rules of Facebook, Twitter, Instagram, Echonest, Urban Airship, Google Maps, and BBC Weather will apply to the app. We reserve the right, at Our sole discretion to suspend and/or terminate your use of the App if we believe you have breached any of the rules of these sites.
  19. Anything you submit via the App ("Submissions") must be suitable for publication and display and must not be indecent or obscene. Submissions must not include symbols, statements or words that are offensive to the general public or to individuals of a particular socioeconomic group, sexual orientation, ethnicity, race or religion. Submissions must not breach any laws or network standards and must not include any threats to any third parties. Submissions must not invade the privacy or any rights of any other person or entity.
  20. Submissions must only refer to or include third party trade marks (those not owned by the promoter) to identify those trade marks in accordance with honest practices and any such reference must be made with due cause and must not take unfair advantage of, or be detrimental to, the distinctive character or repute of the trade mark in question. Submissions must not denigrate any third party trade marks. Submissions must not infringe third party trade mark rights.
  21. By making a Submission to this App, participants grant the promoter a transferable, sub-licensable, royalty free, non-exclusive worldwide licence to reproduce, use, distribute, and make derivative works of their Submissions via any media channel and in any media.
  22. Submissions must not infringe any right of privacy, right of publicity, copyright or any other third party rights. Submissions must not be defamatory.
  23. These terms and conditions are governed by English Law and You and We submit to the non exclusive jurisdiction of the English Courts.
